Article 1 — Purpose
These Terms and Conditions (hereinafter "T&C") govern the sales of KuKirin brand electric scooters made by HF Commerce Limited, BRN 80077837, Hong Kong (hereinafter "the Seller") to its customers (hereinafter "the Customer") via the website kukirin-roma.it.
Any order placed on the website implies the unreserved acceptance of these T&C by the Customer.
The website is exclusively intended for customers residing in Switzerland. Deliveries are made only within Swiss territory.
Article 2 — Products
The Seller offers KuKirin brand electric scooters for sale. Products are described and presented as accurately as possible. However, photographs and descriptions on the website are not contractually binding.
Important: With the exception of the KuKirin G2 Pro ABE (limited to 20 km/h, 500W), all KuKirin models offered exceed the Swiss legal limits for use on public roads. These products are intended exclusively for use on private property. The buyer is informed of this before any purchase.
Article 3 — Prices
Prices are stated in Swiss francs (CHF), all charges included. The Seller reserves the right to modify its prices at any time. Products are invoiced based on the rates in effect at the time of order validation.
Article 4 — Orders
The ordering process is as follows:
- Selection of the desired product(s)
- Add to cart
- Providing delivery information (name, address, phone)
- Choice of payment method
- Validation and payment of the order
- Confirmation by email
The order is considered final after full payment of the price. The Seller confirms the order by email as soon as possible.
Article 5 — Payment
Payment is made online securely via the Stripe platform. The accepted payment methods are:
- Twint
- Bank cards (Visa, Mastercard)
Payment data is processed directly by Stripe and is never stored by the Seller. Payment is debited at the time of order validation.
Article 6 — Right of Withdrawal
In accordance with European Directive 2011/83/EU, the Customer has a right of withdrawal of 14 days from receipt of the goods. This right allows the Customer to cancel the contract without giving any reason and to obtain a full refund.
To exercise this right, the Customer must notify their decision by email before the expiry of the 14-day period. The product must be returned in perfect condition, in its original packaging and with all accessories.
The refund will be made within 14 days of receipt of the returned product, using the same payment method used for the purchase.
Article 7 — Delivery
Delivery is available throughout Switzerland. It is free in Geneva (hand delivery) and charged at 50 CHF for the rest of Switzerland (carrier delivery). Delivery times depend on product availability in stock and will be communicated to the Customer after order validation.
The Seller undertakes to deliver the product within a reasonable time frame. In the event of a significant delay, the Customer will be informed by email or phone.
Article 8 — Warranty
Products benefit from the legal warranty of conformity in accordance with applicable law. In addition, KuKirin scooters are covered by the KuKirin manufacturer warranty, the conditions of which are communicated with the product.
The warranty does not cover damage resulting from misuse, accidents, modifications made to the product, or normal wear and tear.
Article 9 — Liability
Disclaimer: With the exception of the KuKirin G2 Pro ABE (limited to 20 km/h, 500W, approved for public roads), KuKirin scooters exceed the Swiss legal limits for use on public roads. The purchase of these products implies exclusive use on private property. The buyer acknowledges that use on public roads is prohibited and solely assumes the risks in the event of an infringement. The Seller declines all liability in the event of use on public roads.
Article 10 — Personal data
The Seller collects and processes the Customer's personal data in accordance with its Privacy Policy, in compliance with the General Data Protection Regulation (GDPR) and the new Swiss Federal Data Protection Act (nFADP).
Article 11 — Applicable law and disputes
These Terms and Conditions are governed by European Union law and the national law of the Customer's country of residence. In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, the dispute shall be brought before the competent courts of the consumer's domicile.
